Article 1: General
1.1 These general terms and conditions apply to all offers, agreements and deliveries of Cam-it, established at Eusebiusbuitensingel 41, 6828 HX Arnhem, registered under Chamber of Commerce number 95565531.
1.2 By placing an order, the customer agrees to these general terms and conditions. These conditions are available on the website and on request in printed form.
1.3 Deviations from these conditions are only valid if confirmed in writing by Cam-it. Other conditions do not apply unless agreed in writing.
1.4 Cam-it reserves the right to change the general terms and conditions. Customers will be notified of changes in a timely manner.
Article 2: Offer and agreement
2.1 All offers on the website are non-binding and can be revoked at any time, even if they are confirmed.
2.2 An agreement is concluded when the customer places an order and it is confirmed by Cam-it via e-mail. The confirmation contains details of the order, the price, the expected delivery time and the payment terms.
2.3 Cam-it has the right to refuse orders or request additional information before the agreement is confirmed. This may be the case with incomplete or incorrect information.
2.4 Cam-it will notify the customer of any changes in the offer and delivery, such as changes in delivery times or availability.
Article 3: Prices and payments
3.1 All prices quoted are in euros, including VAT and other levies, unless otherwise stated. Cam-it reserves the right to change prices. The prices that apply at the time of the order apply.
3.2 Payment can be made via the payment methods available on the website, including iDEAL, credit card, Maestro, MasterCard, Visa, American Express, Bancontact, Google Pay, Apple Pay, UnionPay and PayPal.
3.3 The customer is obliged to make the payment within the specified period. If payment is not made on time, Cam-it reserves the right to cancel the order or suspend delivery.
3.4 In the event of late payments, Cam-it may charge statutory interest and collection costs, in accordance with the statutory provisions. The customer is liable for the costs arising from the collection.
3.5 If the customer chooses a payment method with additional costs, such as a post-payment service, the customer is responsible for paying these costs.
Article 4: Delivery
4.1 Delivery of the products takes place at the address provided by the customer. The customer is responsible for providing correct and complete address details.
4.2 The delivery time is on average 2 working days, unless otherwise stated. Cam-it is not liable for delays in delivery, unless they are due to intent or gross negligence.
4.3 The customer is obliged to check the delivered products upon receipt for any damage, wrong products or other deficiencies. Any complaints must be reported in writing to Cam-it within 7 days of receipt.
4.4 If a product is not available, Cam-it will notify the customer and offer an alternative or cancel the order. Cam-it is not liable for any damage resulting from an unavailable product.
4.5 Deliveries take place within Europe. Additional shipping costs for international shipments are clearly stated during the ordering process.
4.6 Responsibility for the product is transferred to the customer at the time of delivery. The customer is liable for damage to or loss of the product upon receipt.
Article 6: Guarantee
6.1 A 24-month warranty applies to the delivered products, unless otherwise stated in the product description.
6.2 The warranty covers defects that occur within the warranty period, provided that the product has been used and maintained correctly, as described in the instructions for use provided.
6.3 Customers must report defects in writing to Cam-it within 7 days of discovery. The customer must return the product in the original packaging and with a copy of the purchase receipts.
6.4 If a product becomes defective within the warranty period, the customer is entitled to repair, replacement or refund, depending on the situation and the possibilities. In case of replacement, Cam-it can offer an equivalent product.
6.5 The warranty expires if the customer himself makes changes or repairs to the product, or if the product is exposed to improper use or careless maintenance.
6.6 Cam-it is not liable for damage resulting from use of the products in combination with other products not recommended by Cam-it.
Article 7: Liability
7.1 Cam-it is not liable for indirect damage, consequential damage or damage due to misuse of the products. This includes, but is not limited to, damage to vehicles, other goods or persons.
7.2 The liability of Cam-it is limited to the amount that the customer has paid for the product in question, unless there is intent or gross negligence.
7.3 Cam-it is not responsible for damage caused by improper use, installation or assembly of the products. The customer is responsible for following the instructions and guidelines that come with the product.
7.4 In the event of damage to the customer or third parties due to the use of the products, the customer indemnifies Cam-it from all claims of third parties.
7.5 Customers are encouraged to contact Cam-it in case of doubt about the suitability of a product for their specific situation.
7.6 Cam-it is not responsible or liable for any damage to vehicles, parts or accessories resulting from the installation or assembly of the supplied dashcams. Customers are advised to have the installation carried out by a professional installer or to carefully follow the supplied manual and installation instructions.
Article 9: Applicable law and disputes
9.1 Dutch law applies to these general terms and conditions and all agreements.
9.2 Disputes arising from or related to these conditions or the agreement will be submitted to the competent court in Gelderland, unless the law provides otherwise.
9.3 Cam-it will strive to resolve disputes by mutual agreement. Customers are encouraged to contact customer service before taking legal action.
9.4 For disputes relating to the application of these general terms and conditions, the Dutch version of these terms and conditions shall prevail.
Article 10: Amendments
10.1 Cam-it reserves the right to change these terms and conditions. Changes will be announced on the website and apply to new orders from the date of publication.
10.2 Customers are advised to regularly consult the general terms and conditions for any changes.
Article 11: Customer Service
11.1 For questions, comments or complaints, the customer can contact Cam-it's customer service via Info@cam-it.com or via the chat function on the website.
11.2 Cam-it strives to respond to questions and complaints within 3 working days.
11.3 Customers can also use the FAQ section on the website for frequently asked questions.
Article 12: Other provisions
12.1 If any provision of these general terms and conditions proves to be invalid or unenforceable, the remaining provisions remain in full force.
12.2 These general terms and conditions are drawn up in Dutch. In the case of translations into other languages, the Dutch text is decisive.
12.3 Customers may store and/or print these terms for their own records.
Article 13: Intellectual property
13.1 All intellectual property rights relating to the products and the website of Cam-it, including but not limited to copyrights, trademark rights and database rights, rest with Cam-it or its licensors.
13.2 The customer is not allowed to reproduce, disclose or distribute any information, images or texts of the website without the written permission of Cam-it.
13.3 The customer acknowledges that the products and services of Cam-it represent unique and valuable intellectual property rights and will refrain from any infringement thereof.
Article 14: Force majeure
14.1 Cam-it is not liable for any delay or shortcoming in the execution of the agreement if it is due to force majeure. Force majeure means any circumstance that prevents the performance of the agreement and that cannot be attributed to Cam-it.
14.2 In the event of force majeure, Cam-it will inform the customer as soon as possible about the cause and the expected duration of the force majeure.
14.3 If the force majeure situation lasts longer than 6 weeks, the customer has the right to terminate the agreement without charge.
